Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. Petitioner, who is in custody since 21.06.2021, seeks regular bail in connection with S.T. No. 465 of 2021 arising out of Ishipur (Barahat) P.S. Case No. 49 of 2020 registered for offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.
Prosecution story in brief is that petitioner along with all the family members had committed murder of the wife of the informant due to non-fulfillment of demand of dowry. Learned counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.3589 of 2022(2) dt.18-05-2022 2/3 submits that altogether sixteen persons have been made accused and all of them are family members and relatives. There is no eye witness and allegation is general and omnibus against all the co-accused. Petitioner is Bhainsur of the deceased. He submits that younger brother of the petitioner and other family members have already been granted anticipatory bail vide order dated 27.01.2022 passed in Cr. Misc. No. 32412 of 2021 against whom also similar allegations were made.
Learned A.P.P., for the State has opposed the prayer for grant of bail to the petitioner.
Considering the facts and circumstances of the case, there is general and omnibus allegations against all the accused persons and other co-accused persons against whom also similar allegations were made have already been granted anticipatory bail by a co-ordinate Bench of this Court, the petitioner, above named, is directed to be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge X, Bhagalpur in connection with S.T. No. 465 of 2021 arising out of Ishipur (Barahat) P.S. Case No. 49 of 2020 subject to the following conditions: (i) Bailors should be local having sufficient

(ii) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court. (iii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (iv) If the petitioner is found involved in similar nature of offence, after his release on bail, the trial Court shall take steps to cancel his bail bond.
