JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-02-2022 Heard Mr. Binod Kumar, learned Advocate for the petitioner and Md. Aslam Ansari, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Fatehpur (Gurpas OP) P.S. Case No. 31 of 2020 dated 20.02.2020 instituted for the offences under Sections 341, 323, 308, 504, 506 and 34 of the Indian Penal Code.
Over the issue of irrigation of field, an occurrence took place in which the informant is said to have been assaulted by the petitioner and four others by means of spade.
The injuries suffered by the victim is not in consonance with the ocular testimony. The informant/victim appears to have received injuries in the nature of swelling on both parts of his scrotum. The weapon of assault is stated to be hard and blunt substance.

Considering the afore-noted facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-X, Gaya in connection with Fatehpur (Gurpas OP) P.S. Case No. 31 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
