Petitioner apprehends arrest in a case registered for the offence punishable under Sections 419 and 420 of the Indian Penal Code and Section 66(b), 66(D) of the IT Act. Prosecution case, in brief, on the secret information that some miscreants were committing forgery and cheating near a paddy field by giving temptation to innocent person through mobile, police raided the place and apprehended five persons and recovered several mobile phone set, cash Rs. 1.22 lacs, pass books, cheque book, ATM card of different banks, laptop etc. from their possession.
Learned counsel for the petitioner submits that the name of the petitioner has transpired only on the basis of the
Patna High Court CR. MISC. No.6469 of 2023(2) dt.11-05-2023 2/2 confessional statement of the co-accused. Petitioner has no concern with the alleged occurrence and nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.
Learned counsel for the State opposes the prayer for bail and submits that petitioner is named by one of the coaccused in the case of Cyber crime. Considering the gravity of allegation, prayer for prearrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Alok Verma/- U T
