JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 448, 504, 506 and 307 of the Indian Penal Code. The prosecution case is that the accused persons including the petitioners entered into the house of the informant and assaulted her and her family members. When the informant's son came to rescue her the accused persons assaulted him with lathi, danda and rod.
It is submitted by the learned counsel for the petitioners that none have received injury and there is a counter version of this case also.
Patna High Court Cr.Misc. No.12751 of 2016 (2) dt.28-03-2016 2/2 Considering the facts and circumstances, let the petitioners above named be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Sheikhpura in connection with Barbigha P.S. Case No. 331 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
