2. This writ petition has been filed by the petitioner for quashing the first information report of Vigilance P.S. Case No.139 of 2016 registered under Sections 109, 420, 409, 467, 471, 120B of the Indian Penal Code and Sections 13(2) read with 13(1)(d) of the Prevention of Corruption Act, 1988.

On perusal of the first information report, it would appear that the informant Akhilendra Kumar Singh, Sub Inspector, Vigilance Investigation Bureau, Patna has alleged in his written report dated 13.12.2016 that in preliminary inquiry, it was revealed that by misusing his official position as Chairman, Fatehpur PACCS between the year 2009 and 2014 as well as while he was working as Chairman, Vyapar Mandal, Akbarpur block, he had committed several irregularities in conspiracy with Co-operative Bank Manager and other public servants and by committing forgery purchased paddy enhancing the area of land in rent receipts and using the same rent receipt number of times and purchasing paddy from open market @ Rs.1,000/- per quintal to Rs.1,200/- per quintal and supplied to S.F.C. @ Rs.1,360 + Rs.300/- per quintal bonus provided by the government. It is further alleged that in this manner, the petitioner had plundered crores of the public money in illegal manner.
4. The allegations made in the FIR do attract ingredients of a cognizable offence.
5. In that view of the matter, neither the institution of the first information report or its investigation can be held to be bad.

6. The application, being devoid of any merit, is dismissed.
