This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Raushanganj PS Case No. 79 of 2018 for the alleged offence punishable under Sections 307, 120B/34 and later on Section 302 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel representing the petitioner submits that petitioner has no criminal antecedent. He has remained in custody for more than seven months. He further submits that against the petitioner except suspicion there is no other material. Referring to the order passed by a co-ordinate bench of this Court learned counsel submits that Shiv Kumar Prasad has been
Patna High Court Cr.Misc. No.413 of 2019(2) dt.30-01-2019 2/2 granted bail in Cr. Misc. No. 68885 of 2018 vide order 03.01.2019 whose case stands on similar footing. Considering the totality of the fact situation, this application is allowed. Accordingly, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sherghati at Gaya in connection with Raushanganj PS Case No. 79 of 2018.
