This application is for restoration of Cr. Misc. No. 63053 of 2019, an anticipatory bail matter. By order dated 29.11.2019, the said application was dismissed as not maintainable as the Court was informed that in Para-60 of the case diary it is mentioned that the petitioner has already been arrested.

Learned counsel for the petitioner submits that another co-accused of the same name namely Rohit Kumar, Son of Harihar Prasad was, in fact, arrested and the petitioner Rohit Kumar, Son of Binod Singh has not been arrested uptill now.
