JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 457, 376, 511/34 of the Indian Penal Code.

Petitioner and one co-accused, Birju Rajak along with some unknown persons having entered into the house of the informant tried to outrage her modesty but para-12 of the petition shows that co-accused, Birju Rajak has already been granted privilege of bail by a co-ordinate Bench of this Court and so far as petitioner is concerned, he is languishing in jail custody since 21.01.2016.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.11935 of 2016 (2) dt.17-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Patory P.S. Case No. 302 of 2015.
