2. The application has been filed for quashing the order dated 31.07.2018 passed by learned Sub-Judge-VII, Sasaram, Rohtas in Title Suit No. 526 of 2010 by which learned

Patna High Court C.Misc. No.1671 of 2018(7) dt.31-08-2023 2/2 Judge allowed the amendment application filed by the petitioners.

2. I have heard the submissions of the parties.

3. The amendment application which has been allowed by the learned Judge is bona fide and it does not change the nature of the suit. In these circumstances, there is no need of interfering in the matter.

4. The petitioners are given liberty to file their additional written statement and if required they may recall their witnesses or examine fresh additional witnesses.

5. With the aforesaid observation and direction, this application is dismissed.
