Petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code. Petitioner is named in the first information report but it is only stated that he was also present on the place of occurrence having pistol in his hand and was giving threatening to kill the informant and his other family members.

It is obvious from perusal of the first information report that the petitioner does not even touch the body of the deceased as well as informant and moreover, one co-accused Ran Vijay Singh @ Sanni Kumar @ Sanni, against whom there is allegation of assault, has already been granted privilege of bail by a coordinate bench of this court.

Accordingly, petitioner is directed to be released on bail on
