JUSTICE MUNGESHWAR SAHOO ORAL ORDER 08-02-2016 Heard the learned counsel, Mr. Ranjan Kumar Dubey, for the appellant and the learned counsel, Mr. Vikas Ratat, for the respondent on the interlocutory application No.9968 of 2015. This interlocutory application has been filed by the parties jointly under Order XXIII Rule 1 of the Code of Civil Procedure praying therein to accept the compromise and disposed of this First Appeal in terms of the compromise arrived at between the parties.

It appears that all the parties have singed in the compromise application and affidavits in support of the compromise and the terms and conditions of the compromise has

Patna High Court FA No.265 of 1987 (19) dt.08-02-2016 2/2 also been filed. There is no defect in the compromise application. There is no impediment in the recording of the compromise between the parties also.

In view of the above position that both the parties have compromised and the terms and conditions have been detailed in the compromise application, i.e., I.A. No.9968 of 2015, this compromise application is accepted. The First Appeal is decreed in terms of the compromise. It is directed that the compromise application shall form part of the decree.
