The petitioner seeks bail in connection with Excise Case No. 145 of 2021 arising out of P.R. No. 113 of 2021 instituted for the offences under Sections 30(a) and 30(c) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.11.2021, prosecution report has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that the allegation is of recovery of 15 litres of liquor and 2400 litres of fermented jaggery apart from other articles from bank of Budhi Gandak, Dadar Ghat.

No.3938 of 2022(2) dt.07-03-2022 2/2 Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name came in the confessional statement of co-accused Shatruhan Sahani who has been granted bail vide order dated 04.09.2021 in Cr. Misc. No. 34763 of 2021.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, prosecution report has been submitted in the case and the coaccused on whose confessional statement name of this petitioner transpired has been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Act, Muzaffarpur in connection with Excise Case No. 145 of 2021 arising out of P.R. No. 113 of 2021.
