====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 07-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Arwal P.S. Case No. 56 of 2015, instituted for the offence under Section(s) 394, 302 of the Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused. Counsel for the petitioner further submits that other co-accused persons with similar allegation have already been granted bail by coordinate Benches of this Court vide orders dated 24.5.2016 and 18.8.2016 passed in Cr. Misc. 17403 of 2016 and 32885 of 2016 respectively.

Patna High Court Cr.Misc. No.986 of 2019(5) dt.07-02-2019 2/2 Petitioner is in custody since 1.2.2016.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, in connection with Arwal P.S. Case No. 56 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner.
