JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is, in jail custody since 31.8.2018, seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 447, 302 and 504 of the Indian Penal Code.

Petitioner is named in the first information report but specific allegation of assault to deceased as well as informant is against co-accused Sandip Das @ Chhotu Das. So far as petitioner is concerned, he is said to be simply a member of unlawful assembly. The investigation of this case has already been completed against the petitioner.

Considering the aforesaid facts and circumstances as

No.432 of 2019(3) dt.28-03-2019 2/2 well as submissions of the parties, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah /concerned Court in connection with Majhaulia P.S. Case No. 256/2018.
