JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-01-2019 The petitioners who are brothers among themselves seek bail in anticipation of their arrest in connection with Amba P.S. Case No. 100 of 2018 dated 03.11.2018 instituted for the offences under Sections 341, 323, 308, 504, 34 of the Indian Penal Code.

The learned counsel for the petitioners has submitted that the informant is one of the agnates of the petitioners and with respect to an occurrence dated 03.01.2016, the subject F.I.R has been lodged on 03.11.2018 i.e. after delay of two years. He has also submitted that the informant now does not wish to prosecute the petitioners.

No.358 of 2019(2) dt.29-01-2019 2/2 Regard being had to the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Amba P.S. Case No. 100 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
