The appellant seeks anticipatory bail in connection with Tarari P.S.Case No. 146 of 2018 corresponding to SC/ST case No. 146 of 2018, registered for offences punishable under Sections 279, 294, 336, 504, 147, 506 of the Indian Penal Code and under Section 3(1) (x) of the SC/ST Act, 1989. The allegation against the appellant is of driving negligently and rashly in drunken condition and playing vulgar son loudly on which the son of the informant wants to stop upon which the appellant alongwith others became angry and began to abuse by calling caste name.
Submission of the learned counsel for the appellant is that there is a case and counter case between the parties and F.I.R. itself shows that the injury is found to be simple in
Patna High Court CR. APP (SJ) No.210 of 2019(2) dt.06-02-2019 2/2 nature and the appellant has clean antecedent. Heard learned Special P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this appeal is allowed and the impugned order is set aside, let the appellant, above named, in thie event of his arrest or surrender before the learned court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 25,000/- ( Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Bhojpur, Ara in Tarari P.S.Case No. 146 of 2018 corresponding to SC/ST Case No. 244 of 2018, subject to condition as laid down under Section 438 of Cr.P.C. (Vinod Kumar Sinha, J) sudha/- U T
