JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 18-02-2020 The petitioner had deposited the cheque of Rs. 1 lakh which was issued by the Post Office on maturity of Kisan Vikash Patra in Central Bank of India, Ravindra Sarani Branch, Kolkata where the petitioner maintains an account. The aforesaid cheque had to be sent through the

2/4 Central Bank of India, Kolkata to the State Bank of India, Gopalganj main branch for the amount to be credited in the account of the petitioner. The amount has yet not been credited in the account of the petitioner. The reasons for such non-crediting of the amount is not known to the petitioner.

However, learned counsel appearing for the State Bank of India submits that from the statement of fact received by him, it can be discerned that the cheque in question was returned by the State Bank of India, Gopalganj Main Branch to the Central Bank of India through the clearing office in West Bengal for the reason that outstation cheques are not accepted.

The petitioner is not be blamed for all this. The petitioner maintains an account with the Central Bank of India and had deposited the cheque in question in her bank account at Kolkata to be transmitted to the State Bank of India, Gopalganj Main Branch. The

3/4 reason assigned for returning the cheque unpaid does not appear to be explicable.

The petitioner under the aforesaid circumstances is directed to make an application before the Branch Manager of State Bank of India, Gopalganj Main Branch, Goplaganj within a period of four weeks. On receipt of such application, the Branch Manager shall verify the facts and shall ensure that the cheque is accepted and the cheque amount is credited in the bank account of the petitioner. The Branch Manager of the concerned branch of the State Bank of India shall find out ways and means of ensuring that the Kisan Vikash Patra which has matured and for which cheque has been issued by the concerned Post Office, the amount therein ought to be credited in the bank account of the holder of the Kisan Vikash Patra. Any delay in the matter for whatever reason would be attributable to the Bank.

The petitioner shall be made known the action taken by the Branch Manager of the Gopalganj Branch of

4/4 the State Bank of India within a period of thirty days of the receipt of such application.

With the aforesaid direction/observation, the writ petition stands disposed of.
