JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 36 and 41 of the Bihar Prohibition and Excise Act, 2016.

The alleged recovery is said to have been made from Parti land of one Nand Kumar Upadhayay. The petitioner was neither caught on spot nor anything recovered from his conscious possession.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount
