JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-03-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Neither the petitioner was caught on the spot nor anything was recovered from his conscious possession. It appears that name of the petitioner came in confessional statement of co-accused who was caught by the police on the spot. Moreover, except the present case as well as Ara Nawada P.S. case No. 35/2014 registered under Section 323 of the IPC, the petitioner does not have any criminal antecedent. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Ara, Bhojpur in connection with Buxar Rail P.S. case No.1/2016.
