2. The present application has been filed for directing the respondents to complete the investigation in Dehri Town (Indrapuri O.P.) P.S. Case No.03 of 2023 for the offences u/s 365 and 34 of the Indian Penal Code, wherein the son of the petitioner was earlier abducted on 01.01.2023 and later his dead body was found in the nearby canal on 09.01.2023. For directing the Criminal Investigation Department, Bihar, Patna to take over the investigation and complete the same within a fixed time

Patna High Court CR. WJC No.107 of 2025(2) dt.03-07-2025 2/2 frame on account of the fact that the conduct and manner of investigation being done by the local police authorities raises suspicions of connivance between the accused persons and the local police. And for any other relief(s) to which the petitioner is found entitled to in the facts and circumstances of the case.

3. In view of the ratio laid down by the Supreme Court in the case Sakiri Vasu vs. State of U.P. (2008) 2 SCC 409, petitioner is directed to move before the concerned Court below for the redressal of his grievance. If such an application is filed before the Court below, the Magistrate will pass necessary order pursuant to the prayer of the petitioner in accordance with law.

4. With the aforesaid direction, this application stands disposed of.
