The petitioner is in custody in connection with Abadpur P.S. Case No. 135 of 2018 for the offences under Sections 30(a) read with Section 13 of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedents and he is in custody since 20.11.2018. He further submits that in the instant case 30 litres of country made wine was recovered from the sack which was tied on the bicycle carried by the petitioner and he further submits that he has been falsely implicated in this case and nothing incriminating articles has been recovered from the possession of the petitioner.

No.533 of 2019(2) dt.17-01-2019 2/2 Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned 2nd Additional District Judge-cum- Special Judge, Katihar in connection with Abadpur P.S. Case No. 135 of 2018.
