JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2015 Petitioner is languishing in custody since 12.07.2013 in a case registered for the offences punishable under Section 395 of the Indian Penal Code and Section 3⁄4 of the Explosive Substances Act.

The accusation is of committing dacoity in the house of the informant. The name of the petitioner sprang up on confession of the co-accused.

The statements have been made in para 7 and 8 of the petition that petitioner has neither been put on test identification parade nor any recovery has been made from the possession of the petitioner.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional

Since the petitioner is accused in four other cases, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial.
