The petitioner is in custody since 17.11.2013 in a case for the offence registered under Sections 489(B), 489(C), 420, 120B of the Indian Penal Code.

The allegation against the petitioner is that he was an active participant of the racket regarding forged and fake currency notes.

It is further submitted on behalf of the petitioner that the recovery of the currency notes was made from red

Patna High Court Cr.Misc. No.21638 of 2014 (6) dt.02-03-2015 2/2 motorcycle and petitioner has nothing to do with the alleged recovery. It is further submitted that one Arvind Rai, coaccused has been extended the privilege of regular bail in connection with the present case vide order dated 06.04.2010 passed in Cr. Misc. No. 738 of 2010 whose name had figured alongwith the petitioner's name in the confessional statement made before the police by one Sanjay Rai. Since Arvind Rai has been granted bail, petitioner being similarly situated person may also be extended the same privilege.

Considering the aforesaid submissions and the period of custody and also the fact that apart from this case petitioner is an accused in one other case of dissimilar nature, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Rajapakar (Baranti OP) P.S.
