2. The petitioner seeks regular bail in connection with Sidhwalia P.S. Case No. 149 of 2023 lodged under sections 341, 323, 324, 325, 447, 504, 506 & 34 of the I.P.C. and subsequently, added section 307 and 302 of the I.P.C.

3. As per the prosecution case, the F.I.R. has been lodged against 13 named accused persons including the petitioner against whom there is an allegation that they gathered together and attacked on the house of the informant and caused injury to the informant and his son.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that informant and petitioner both are resident of same

He submits that due to land dispute, the present occurrence took place in which the specific allegation of assault is against Kishore Sahni and Dinesh Sahni and there is nothing specific of act or overt act upon the petitioner. He further submits that petitioner has been made accused only by virtue of family members.

5. Counsel further submits that petitioner is in custody since 19.08.2023 having clean antecedent.

6. Learned counsel for the State opposes the prayer for bail.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Gopalganj in connection with Sidhwalia P.S. Case No. 149 of 2023, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.
