JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 395 and 397 of the Indian Penal Code. It appears that petitioner does have criminal antecedent of near about eleven cases but in present case, the impugned order reflects that the name of petitioner came in confessional statement of co-accused Rajendra Paswan, who has already been granted privilege of bail by a Co-ordinate Bench of this Court vide order dated 15.1.2016 passed in Cr. Misc. No.53338 of 2015. It appears that except the aforesaid confessional statement as well as criminal antecedent, there is nothing against the petitioner.

Patna High Court Cr.Misc. No.11926 of 2016 (2) dt.17-03-2016 2/2 Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Araria in connection with Forbesganj (Simraha) P.S. Case No.118 of 2015.
