The petitioner apprehends his arrest in connection with Complaint Case No.511(C) of 2022, registered for the offences punishable under Sections 323, 341, 498(A) of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

The petitioner and other co-accused persons are said to have tortured the complainant physically and mentally for non-fulfillment of demand of additional dowry. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as

Patna High Court CR. MISC. No.4453 of 2023(2) dt.04-05-2023 2/2 stated in paragraph-3 of the bail application. It is further submitted that in the learned court below, the complainant has refused to live with her husband, which fact has come in the impugned order also.

Taking into consideration the fact that the complainant is not ready to live with her husband, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Complaint Case No.511(C) of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.

If so advised, either of the parties will be at liberty to make an application before the learned court below for referring the matter to the District Mediation Centre for the purpose of reconciliation or for one time settlement.
