Petitioner apprehend his arrest in connection with Patrakar Nagar P.S. Case No. 715 of 2019 for the offence registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act pending in the Court of A.C.J.M.-VIII, Patna.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. Further submission is that petitioner is not named in the first information report.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending

Patna High Court CR. MISC. No.4616 of 2020(4) dt.09-07-2020 2/2 that it has come in paragraph 15 of the supplementary case diary against the petitioner that the petitioner has provided the pistol and cartridges to the deceased on payment of Rs. 30,000/-. Hence, this is not a fit case for grant of anticipatory bail. Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the State, this Court is not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner for grant of anticipatory bail is rejected.
