JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 11-08-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Babubarhi P.S. Case No. 264 of 2019, registered for the offence under Sections 341, 323, 324, 307, 379, 354 (B) and 504 /34 of the Indian penal Code.

As per allegation, the accused persons badly assaulted the informant and his brother. The specific allegation against the petitioner is that he assaulted on the head of the informant with an axe.

Learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent. He has submitted further

No.3687 of 2022(2) dt.11-08-2022 2/2 that though the nature of injury report has not been mentioned in the order of learned Additional Sessions Judge- XI, Madhubani but in Paragraph 7 in the bail petition, the petitioner has specifically mentioned that all the injuries are simple in nature. Considering the above-mentioned facts and circumstances, as well as the clean antecedent of the petitioner, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Learned Additional Chief Judicial Magistrate- III, Madhubani in connection with Babubarhi P.S. Case No. 264 of 2019, subject to condition as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) shweta/mahesh U T
