2. The petitioner seeks regular bail in a case registered for the offence under Sections 25(1-b) A, 26 and Section 35 of the Arms Act.
3. As per the prosecution case, illegal weapons were recovered from the possession of one Vikash Kumar.
4. Learned counsel for the petitioner submits that the petitioner has not been caught on the spot and he has been named in the confession of the co-accused Vikash Kumar. Petitioner is in custody since 13.10.2023.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and
Patna High Court CR. MISC. No.5689 of 2024(2) dt.17-02-2024 2/2 circumstances, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail after framing of charge if the charge has not been framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria/concerned Court below in connection with Narpatganj (Ghurna) P.S. Case No. 591 of 2023 subject to condition that:- 7(i). The petitioner will mark his attendance at the Narpatganj (Ghurna) Police Station, Arara on every week of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Shishir/- U T
