2. The petitioner seeks bail in connection with Rahika P.S. Case No. 09 of 2019 instituted for the offences punishable under Section 306 of the Indian Penal Code.

3. The allegation against the petitioner is that he abducted the minor daughter of the informant and has taken to Delhi after misleading her where his daughter has committed suicide due to torture.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that the daughter of the informant herself committed suicide due to torture by her parents. He further submits that after

Patna High Court CR. MISC. No.16873 of 2025(4) dt.02-07-2025 2/3 investigation the police has submitted chargesheet under Sections 363 and 305 of the Indian Penal Code. Petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 24.12.2022.

5. Learned APP opposes the prayer for bail.

From perusal of the FIR, report regarding the present stage of trial and also perused the impugned order dated 03.06.2024 passed by the learned Additional Sessions Judge-IV, Madhubani it appears that on the basis of written report of the informant Ramchandra Thakur, FIR has been lodged under Section 306 of the Indian Penal Code against the present petitioner. It also appears that the trial against the petitioner is in advance stage as submitted by the trial Court regarding the stage of trial vide letter no. 92 of 2025. Out of eight prosecution witnesses seven witnesses have already been examined. P.W. 7 has been examined on 16.05.2025. Only the doctor is left to be examined and the trial is likely to be conducted within two months, so considering all these aspects of the case that the trial is an advance stage, I am not inclined to grant bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.

8. The trial Court is directed to expedite the trial expeditiously.
