The petitioner is named in the first information report but no specific overt act has been attributed against him. It would appear from perusal of the impugned order that before the learned Sessions Judge, the learned P.P. had argued that there was allegation of firing against the petitioner but it is surprising enough that the learned P.P. made the above-said argument before the learned Sessions Judge without perusing the case diary because it would appear from the impugned order itself that at the time of passing of the order, the case diary was not available.
