JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-06-2015 Heard learned counsels for the petitioners and learned APP for the State.
The petitioner no.1 being husband of the victim and petitioner no.2 being brother of petitioner no.1 is languishing in custody since 07.01.2015 in a case registered for the offences punishable under sections 304B and 201/34 of the Indian Penal Code.
Accusation is of killing the daughter of the informant after few months of marriage.
It is submitted by learned counsel for the petitioners that the victim all of sudden died and intimation was given to the informant but the FIR was lodged with fifteen days delay and the investigation has already concluded.
Patna High Court Cr.Misc. No.20342 of 2015 (3) dt.25-06-2015 2/2 Considering the fact that the thrust of accusation is against petitioner no.1, Amarjit Prajapati, this Court is not inclined to grant bail. Accordingly, the application with respect to him is rejected.
So far as petitioner no.2 Sintu Prajapati is concerned, since the accusation is omnibus and general against the entire in-laws family and not specific against petitioner no.2, who claims to be separate from the husband of the victim, let him be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gaya in connection with Imamganj P.S. Case No.43 of 2012.
