====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Chakiya P.S. Case No. 271 of 2018, instituted for the offence under Section 414 of the Indian Penal Code, Sections 30(a), 38(1) and 41(1) of Bihar Prohibition and Excise Act.
It is alleged in the written report that 240 liters of Spirit has been recovered from dickey of Maruti Suzuki car. It is further alleged that two persons started running away from the Car. On chase, one person has been apprehended by the police who disclosed his name as Sandip Kumar (petitioner). He also disclosed the name of person who managed to run away as Rajesh Singh.
Counsel for the petitioner submits that there is no
Patna High Court Cr.Misc. No.1882 of 2019(2) dt.15-01-2019 2/2 recovery from possession of the petitioner. He is in custody since 11.10.2018 having clean antecedent. He has been arrested by the police on suspicion.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge-cum-Special Judge, Excise Act, East Champaran, Motihari, in connection with Chakiya P.S. Case No. 271 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
