Learned counsel representing the petitioner and the State are appearing and making submissions from their residence. The Court Master and Secretary are also part of this virtual court proceedings from their homes, all with the aid of audio visual technology.

Heard the parties.

It is pointed out by the petitioner's counsel that copy of

Patna High Court CWJC No.1191 of 2020(4) dt.01-07-2020 2/3 counter affidavit has been served on him. The same discloses that GPF and Group Insurance has been paid to the petitioner. In so far as the Leave Encashment is concerned, it is submitted that the same has been processed and forwarded to the Office of the Accountant General. In so far as the Pension and Gratuity, it is his submission that the PPO has been issued by the office of the Accountant General recently on 15.06.2020. The admissible dues of the petitioner under the head retiral dues has been paid, or is on the verge of payment.

As per the submission of the respondents today, for processing and finalizing payment due and admissible under the head Leave Encashment, Pension and Gratuity, this Court would direct that the respondents must complete the process within a period of four (04) weeks from the date of receipt/production of a copy of this order.

Mr. Shiv Kumar, counsel for the petitioner, submits that certain periods have been excluded for the grant of salary as petitioner has been granted extraordinary leave without pay under order contained in Annexure-E, dated 10.02.2020 issued by Government in the Health Department. He submits that the petitioner be allowed liberty to assail the said order before the appropriate forum.
