JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and one co-accused were caught by the police and firearm was recovered from possession of co-accused whereas nothing was recovered from conscious possession of the petitioner. Petitioner does not have any criminal antecedent. The learned 5th Additional Sessions Judge, Bhojpur at Ara, rejected the prayer for bail of the petitioner without taking note of the aforesaid fact as well as without applying his judicial mind.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S.Case No. 542 of 2015.
