JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-04-2022 Heard learned counsel for the petitioner and the State. Petitioners seek regular bail registered for the offences punishable under sections 8/20(b)(ii) C/22(c) of the NDPS Act.

Police raided a house and arrested four persons including the petitioner and recovered one kilogram Smack (Morfin).

Learned counsel for the petitioners submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. Petitioner claims clean antecedent and is in custody since 24.05.2021 and investigation in this case is complete.

Patna High Court CR. MISC. No.4271 of 2022(3) dt.15-04-2022 2/2 Learned counsel for the State opposes the prayer for bail and submits that huge quantity of narcotic substance has been recovered from the house in which petitioner was also present and was apprehended on the spot.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
