Petitioner apprehends arrest in a case registered for the offences punishable under Sections 39, 30(a), 41 of the Bihar Prohibition and Excise Act.

As per prosecution case, 200 liter of illicit liquor has been recovered from a boat.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He next submits that name of the petitioner transpired during course of the investigation. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims clean antecedent.

No.4598 of 2023(2) dt.07-04-2023 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Exclusive Special Excise Court, Saran at Chapra in Mashrakh Case No. 116 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
