The petitioner apprehends his arrest in Excise Case No.320 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The gist of allegation is that 2.250 litres of Indian made foreign liquor is said to have been recovered from the campus of the house of petitioner.

Learned counsel for the petitioner submits that there is nothing on record to show that the petitioner had kept the liquor inside the campus. The house is of joint family and there is open campus.

Having considered the facts and the nature of allegation against the petitioner, the above named, petitioner in

Patna High Court Cr.Misc. No.712 of 2019(2) dt.21-01-2019 2/2 the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge III-cumSpecial Judge, Excise, Samastipur in connection with Excise Case No.320 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
