2. The petitioner has preferred this application for grant of regular bail in connection with Begusarai Cyber P.S. Case No. 12/2024 dated 13.04.2024 registered for the offence punishable u/ss 467, 468, 471, 419 and 420 read with Section 34 of the Indian Penal Code and Section 66D of the I.T. Act.
3. As per the prosecution case, the co-accused, namely, Prince Kumar assured the informant that he would employ him in Horlicks company and for this the accused person took Aadhar card, PAN card, photo and finger print of the informant several times. Thereafter, the accused person opened account no. 5149297038 in Mahindra Bank and another
Patna High Court CR. MISC. No.3555 of 2025(2) dt.14-02-2025 2/3 account no. 501023587881 as NSDL in the name of the informant. The accused person started operating the account of the informant and took ATM Card of the informant and started withdrawing money through these accounts. It is further alleged that the co-accused, Abhishek Kumar was also involved in this and he used to operate the aforesaid accounts for money transactions.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in this case in the confessional statement of the co-accused, Rajam Kumar. Learned counsel has submitted that the petitioner is neither involved in cyber crime nor he had opened a bank account of any person. The similarly situated co-accused, Abhishek Kumar has already been granted bail by this court vide order dated 12.09.2024 passed in Cr. Misc. No. 61513 of 2024. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 02.12.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in connection with Begusarai Cyber P.S. Case No. 12/2024.
7. The application stands allowed.
