JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 The petitioner apprehends his arrest in connection with Hawai Adda P.S.Case No. 271 of 2018 registered under Sections 323, 341, 406, 498A and 504/34 of the Indian penal Code and 3 and 4 of the Dowry Prohibition Act. Allegation against the petitioner is of subjecting his wife to cruelty and harassment with respect to demand of dowry of Rs. 50 lacs.

Submission of learned counsel for the petitioner is that earlier petitioner has filed an application for restitution of conjugal right and he is still ready to keep her. Heard learned APP also and perused the impugned order from which it appears that an attempt for compromise was made in between the parties but due to allegation and counter allegation, no compromise could be reached between them.

No.1128 of 2019(2) dt.17-01-2019 2/2 Considering the aforesaid facts and circumstances, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Smt. Tanveer Kaur, J.M., 1st Class, Patna in connection with Hawai Adda P.S. Case No. 271 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further conditon that in future if any maintenance case is filed by the wife of the petitioner, he shall co-operate in the disposal of the same otherwise, informant will have liberty to move for cancellation of his bail bond.
