The petitioner seeks regular bail in connection with Ghosi P.S. Case No. 52 of 2016 registered for the offence punishable under Section 395 of the Indian Penal Code. The allegation of the prosecution is regarding unknown accused persons having committed dacoity in the night by looting drivers of several trucks.

The learned counsel for the petitioner submits that the petitioner is not named in the FIR and he has been remanded in the present case after he was arrested in one other case. It is further submitted that neither any T.I. Parade has taken place nor any recovery has been made from the petitioner, hence there is no material to connect the petitioner with the alleged crime.

No.2074 of 2019(2) dt.17-01-2019 2/2 Lastly, it is submitted that similarly situated co-accused persons have already been granted bail by this Court by an order dated 04.10.2016 passed in Criminal Misc. No. 42674 of 2016 as well as the one dated 08.09.2016 passed in Criminal Misc. No. 37373 of 2016. The petitioner is stated to be in custody since 16.08.2018, on which date he was remanded in the present case from other case.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Jehanabad in connection with Ghosi P.S. Case No. 52 of 2016.
