JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Jehanabad Mahila P.S. Case No. 36 of 2019 registered for the offences punishable under Section 354B of the Indian Penal Code and Section 8 of POCSO Act. As per FIR petitioner has attempted to commit rape upon eight years old daughter of the informant. Submission of learned counsel for the petitioner is that as a matter of fact grandfather of petitioner has allotted some land to the father of the informant for making construction of house, where there is dispute with respect to Rasta and for that the present case has been filed.
Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner stating that the supervising authority has found the case true under Sections 376/34 and
Patna High Court CR. MISC. No.2499 of 2020(2) dt.24-01-2020 2/2 354B IPC against the petitioner and moreover the witnesses have supported the prosecution case during investigation. In view of allegation, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He has to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order. This application is, accordingly, dismissed.
