The petitioners have prayed for grant of bail in connection with Mirganj P.S. Case No. 347 of 2022 registered under section 395 of the Indian Penal Code.

Patna High Court CR. MISC. No.4392 of 2023(5) dt.07-04-2023 2/3 Allegation against the petitioners is that they snatched the motorcycle as well other articles which were kept in the bag on pistol point from the informant and fled from the place of occurrence.

Learned counsel for the petitioners submits that the petitioner are innocent and have committed no offence. They have falsely been implicated in this case. The petitioners are not named in F.I.R. rather their names came into light in this case on the basis information supplied by spy of the police. Neither the petitioners were arrested on spot nor any stolen article has been recovered from the conscious possession of the petitioners. They have not been put on T.I.P. Moreover, they are languishing in judicial custody since 04.10.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of this case as well as the custody of the petitioners, the Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Mirganj P.S. Case No. 347 of 2022 on each of them furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like
