The petitioner seeks regular bail in Delha P.S. Case No. 159/2018, registered for the offences punishable under Sections 401, 457, 380, 411 and 34 of the Indian Penal Code. It is alleged in the written report that three persons tried to hide themselves behind the temple on seeing the police party. They were apprehended. On search, one iron Hexa blade, two iron rods and mobile were recovered from possession of the petitioner and other accused persons named in the F.I.R. Learned counsel for the petitioner has submitted that seizure list is part of F.I.R. which shows there is no recovery from conscious possession of the petitioner rather aforesaid articles have been recovered from Dhania Bagicha near
Patna High Court Cr.Misc. No.687 of 2019(2) dt.18-01-2019 2/2 Mahadev Sthan. Petitioner is in custody since 21.06.2018. The other accused with similar allegation has been granted bail by this court by order dated 02.11.2018 passed in Cr. Misc. No. 65564/2018 (Annexure-2).
Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 7th, Gaya in connection with Delha P.S. Case No. 159/2018, subject to the condition that both the bailors will be close relative of the petitioner.
