Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Balia Belon P.S. Case No. 80 of 2021 lodged under Sections 304(B)/34 of the I.P.C.

Learned counsel for the petitioner submits that petitioner is the mother-in-law of the deceased. He further submits that husband is already in custody. He submits that there are general and omnibus allegation against this petitioner. He submits that petitioner is in custody since 28.07.2021, charge sheet has already been filed in this case. There is no criminal antecedent of the petitioner. He further submits that the other

No.4614 of 2022(3) dt.25-08-2022 2/2 co-accused that is father-in-law of the deceased was granted bail by the Co-ordinate Bench of this Court vide order dated 18.07.2022 passed in Cr. Misc No. 65340 of 2021. Learned counsel for the State opposes the prayer for bail and submits that the daughter of the deceased has informed to the informant that her father and grand-mother killed her mother. Her age is 3 years only.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at this stage but trial court is directed to release the petitioner on bail to his satisfaction after framing of charge in this case.
