The petitioner seeks bail in a case registered for the offences punishable under sections 385, 386 and other allied sections of the Indian Penal Code.

Petitioner Dilip Mandal @ Dillo Mandal @ Dulwa Mandal is said to have demanded extortion from the informant and his owner.

It is submitted that the informant has named Dilip Mandal @ Dulwa Mandal resident of village Bariarpur, but the petitioner is a resident of village Lailakh, P.S. Sabour District Bhagalpur. On mistaken identity the petitioner was apprehended. He is rotting in jail since 04.04.2015 i.e. for about five months. Considering the facts aforesaid, the petitioner
