JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 302 and other allied Sections of the Indian Penal Code as well as Section 27 of the Arms Act.
Petitioner is not named in the first information report but from perusal of the impugned order, it would appear that the name of the petitioner came in this case in the confessional statements of co-accused persons and after that petitioner was remanded in this case from Matihani P.S. Case No.89 of 2014. The learned court below rejected the prayer for bail of the petitioner on the ground of aforesaid confessional statements as
Patna High Court Cr.Misc. No.14759 of 2016 (2) dt.08-04-2016 2/2 well as criminal antecedent of the petitioner. Contention on behalf of the petitioner is that no doubt, petitioner does have criminal antecedent of near about seven cases, but in the present case, there is no cogent material to show his involvement.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Begusarai in connection with Sessions Trial No.54 of 2016 arising out of Matihani P.S. Case No.24 of 2015.
