The petitioner seeks bail in anticipation of his arrest in connection with Dhankund P. S. Case No. 30 of 2018, dated 12.03.2018, instituted for the offences under Sections 42, 467, 468, 469 and 471 of the Indian Penal Code.
He is alleged to have made uauthorized
Patna High Court CR. MISC. No.15028 of 2021(2) dt.25-02-2022 2/3 withdrawals and payment to teachers in his capacity of Drawing and Disbursing Officer.
The learned Advocate for the petitioner has submitted that after about 11 years of the retirement of the petitioner, this case has been filed.
However, the disputed amount, attributable to the petitioner, has been deposited by him but subject to his rights and contentions later.
Considering this aspect of the matter, one of the other accused persons of this case, namely, Prabhunath Chaurasia, has been granted anticipatory bail by a Bench of this Court vide order dated 13.02.2019, passed in Cr. Misc. No. 8574 of 2019.
Regard being had to the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the
Patna High Court CR. MISC. No.15028 of 2021(2) dt.25-02-2022 3/3 learned Chief Judicial Magistrate, Banka, in connection with Dhankund P. S. Case No. 30 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C. The application stands allowed.
