JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-05-2023 Heard learned counsel for the petitioners and the State. Petitioners apprehend arrest in a case registered for the offence punishable under sections 285/379/413/414/34 of the Indian Penal Code.

As per the prosecution case, petitioners and other accused persons were involved in selling diesel illegally and 8000 liters diesels were recovered from the place of occurrence. Learned counsel appearing for the petitioners submits that petitioners name has figured during course of investigation in confessional statement of co-accused who were apprehended on the spot. Petitioner no.1 is owner and petitioner no.2 is driver of the vehicle. They have got no concern with the alleged act.No incriminating material has been recovered from the conscious possession of the petitioners. Petitioners

Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Sherghaty, Gaya in Sherghati Dobhi Police Station Case No. 780 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
