JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-04-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the victim is languishing in custody since 1.12.2015 in a case registered for the offences punishable under Sections 304B/34 and 498A of the Indian Penal Code.

The accusation is of killing the sister of the informant after two and half years of marriage for non fulfillment of dowry demands by throttling her.

It is submitted by the learned counsel for the petitioner that accusation is omnibus and general. It is further submitted that the informant retracted from the initial version and has filed a petition to that effect before the learned court below. Considering the fact that the accusation levelled in the FIR is being corroborated by the medical opinion, this court is not

Patna High Court Cr.Misc. No.16295 of 2016 (2) dt.13-04-2016 2/2 inclined to grant bail to the petitioner in connection with Ladaniya P.S. Case No. 102 of 2014 pending in the court of learned J.M Ist Class, Madhubani.

This application is, accordingly, dismissed.
